FanDuel in New Hampshire


FanDuel is one of the two largest US sportsbook operators, alongside DraftKings — but New Hampshire is one of the few legal sports betting states where FanDuel Sportsbook does not operate. The reason is structural: NH awarded its entire mobile and retail sportsbook market to DraftKings through an exclusive bidding process. FanDuel's daily fantasy product, however, operates legally in NH.

Why FanDuel Sportsbook Isn't in NH


DraftKings won the exclusive contract

In November 2019, the NH Lottery Commission selected DraftKings from 13 bidders after a competitive RFP process. FanDuel was among the bidders but lost on revenue share — DraftKings offered 51% to the state.

Contract extends through 2028

The exclusive contract was extended in February 2026 through June 30, 2028, with a potential second 2-year extension through 2030. No competitor can legally enter the NH sportsbook market during this period.

State has strong financial incentive to maintain monopoly

The DraftKings contract specifies that adding competitors would drop the state's revenue share from 51% to 21% or lower. NH receives more revenue from a DraftKings monopoly than it would from a competitive multi-operator market.

FanDuel DFS is a separate product

Daily fantasy was legalized in NH under HB 580 (2017) — two years before sports betting. DFS is classified as a game of skill, not gambling, and operates under a different licensing framework. FanDuel DFS competes openly with DraftKings DFS, Sleeper, Underdog, and PrizePicks in NH.
